  Hot Issues in Lending Compliance

WHAT?

The topics that are "hot" shift from time to time. But the two hottest topics in lending compliance, at present, are flood insurance and the FACT Act.

Flood insurance is doubly "hot." The regulators continue to place major emphasis on the topic during compliance examinations. And, since the hurricanes of 2005, Congress has been reworking the law. Over 100 bills to revise flood insurance or "fix" FEMA have been introduced. The bills are starting to consolidate. A final bill will be completed soon.

Congress passed the FACT Act, which amends the Fair Credit Reporting Act, in December 2003. All of the many provisions of the law were supposed to be completed by December 2004, but a few provisions still are not complete. Several major sections were completed during 2006 and two major new sections have been proposed in recent months.

For both topics participants receive:

  • An update on the current status of the laws;
  • A review of recent revisions;
  • A review of frequently cited violations; and
  • A preview of coming attractions.

    The program includes a review and update on:
  • Flood Disaster Protection Act - including a review of bills moving through Congress that significantly revise flood insurance rules; and
  • Fair Credit Reporting Act - includes coverage of the:
  • FACT Act Medical Information Rules, which were finalized a few months ago; and
  • Significant new Red Flag Guideline provisions, which were recently proposed.

    WHY?
    Both topics result:
  • In the need for new or revised policies and procedures;
  • In the need for training on the new and revised rules; and
  • Increased scrutiny from examiners.

    WHO?
    The program is designed for compliance officers, auditors and those in the lending area with responsibilities for maintaining compliance and implementing new requirements.

    PRESENTER
    Jack Holzknecht is a principal with Pegasus Educational Services, LLC, a training firm headquartered in Louisville, Kentucky. He is an experienced consultant who has provided training to thousands of bankers and examiners for twenty-four years. He has the ability to identify the key compliance issues from each regulation. Jack's career began in 1976 as a federal bank examiner. He later headed the form and software and education divisions of a regional consulting company. In that capacity he developed loan and deposit form systems and software. He also developed and presented training programs to bankers in 43 states. Jack has been an instructor at compliance schools presented by the Georgia, Iowa, Kentucky, Pennsylvania, Nebraska, New York and Texas bankers associations. He developed and delivered compliance training for the FDIC and OTS for ten years. He is a Certified Regulatory Compliance Manager and a member of the National Speakers Association.
