  Revised BSA/AML Examination Procedures: Preparing for Your Next Examination

WHAT?

This July, the regulatory agencies issued revised Bank Secrecy Act (BSA) / Anti Money Laundering (AML) examination procedures, updating procedures issued only last year. This webinar that shows you how to use those revised examination procedures to evaluate and improve your BSA and AML compliance and audit programs. It puts you in a position to use the procedures defensively, developing programs that anticipate rather than react to regulatory evaluation.

WHY?

Compliance with BSA/AML requirements is a safety and soundness issue. As recent headlines prove, BSA/AML compliance is critical to the daily operations of every U.S. financial institution. However, since it's a safety and soundness issue, BSA/AML "compliance" requires a lot more than just adherence to the specific requirements of the law and the interpretive regulations. It means understanding and anticipating the on-site examination process.

This webinar focuses on anticipating that examination process by using the most effective BSA compliance management tool available, the interagency BSA/AML examination procedures as revised in July, 2006. Critical additions to those procedures, such as enhanced guidance on developing a risk assessment, are emphasized.

The agencies have developed well organized, useful resource to guide their future examinations. This session compliments and builds on that resource, presenting bankers with ideas on how to use the new procedures as tools in the maintenance and design of their BSA compliance and audit programs. Banks that build BSA/AML compliance programs and audits that reflect the thought processes and organization of the examination procedures enhance their compliance efforts and facilitate the review process.

The materials are presented from the perspective of the banker, not a regulatory agency and the recommendations made are realistic and practical.

The presentation focuses on the implementation and audit of an effective BSA/AML compliance program. Content includes:

  • Should we be looking at a wholesale revision of our approach to BSA/AML compliance or are some well placed tweaks enough?
  • How to use the examination procedures in designing policies and procedures?
  • How to use the examination procedures in designing an independent examination?
  • Are there ways to make ancillary use of the procedures, such as in developing training materials we know the regulatory agencies will respect?

    The Speaker:

    Ken Golliher is a principal with Pegasus Educational Services, LLC, a training firm headquartered in Louisville, Kentucky. He is an experienced banker with a unique ability to reduce complex legal concepts to plain English. He has explained the "why" and "how" of regulations to thousands of financial institution personnel and examiners. Ken's banking career began in 1972 and includes serving as a teller, commercial operations manager and as trust department legal counsel in a state and a national bank. For ten years he headed the education division of a regional consulting firm for financial institutions. He has served on the faculty of the LSU Graduate School of Banking, the OTS' Level I Compliance School and the FDIC's Advanced Consumer Protection School for examiners. He has presented seminars in more than 25 states and has served as an instructor at compliance schools sponsored by the Illinois, Indiana, Georgia, Kansas, Kentucky, Nebraska, Pennsylvania and Texas bankers associations.
